Event Waiver & Release of Liability
By registering for and/or attending the GYC Combined Christmas Party (the “Event”) hosted by the Geraldton Yacht Club (“GYC”), you (“Participant” or “Guardian” if signing on behalf of a minor) agree to the following terms:
1. Assumption of Risk
I understand that participation in the Event, while intended to be family‑friendly and enjoyable, may involve inherent risks, including but not limited to slips, trips, falls, crowding, food and beverage consumption, interaction with other attendees, and potential exposure to allergens, illness or other hazards. I voluntarily accept and assume all such risks on behalf of myself and any minors in my care.
2. Release and Waiver of Liability
To the fullest extent permitted by law, I hereby release, waive, discharge, and covenant not to sue Geraldton Yacht Club, its officers, directors, employees, volunteers, sponsors, contractors, agents, and affiliates (the “Released Parties”) from any and all claims, demands, causes of action, liabilities, losses, damages or costs (howsoever arising) for injury (including death), property damage, illness, or other harm, whether directly or indirectly, that may result from my attendance or participation in the Event, whether caused by the negligence (ordinary, gross, or otherwise) of any Released Party or otherwise.
3. Supervision of Minors
I acknowledge that although the Event is marketed as family-friendly, parents and guardians are fully responsible for supervising their children at all times. I understand that GYC staff, volunteers or event organizers will not assume responsibility for the supervision, care, or safety of minors.
4. Alcohol Consumption
If I consume alcohol at the Event, I confirm that I am of legal drinking age and agree to do so responsibly. I understand that any intoxicated or inappropriate behavior may result in my removal from the Event, at the discretion of the event organizers or GYC, without refund.
5. Health, Safety & Compliance
I agree to comply with all safety instructions, rules, and directions provided by GYC or event staff. I confirm that I (and any minors accompanying me) are physically and mentally capable of safely participating in the Event. If I have any allergy, medical condition, or dietary restriction, I will advise the Event organisers in advance or carry necessary medication.
6. Media / Photography / Videography Release
I grant to GYC, its agents, licensees, and assigns the right to take, use, reproduce, publish, display, distribute, or otherwise exploit photographs, video, or audio recordings made at the Event, which may include my likeness and/or the likeness of minors in my care, for promotional, marketing, archival, or other lawful purposes, in any medium, worldwide, in perpetuity, without compensation.
If I (or a minor in my care) prefer not to be photographed or included in media, I must notify GYC in writing prior to or at the start of the Event to request exclusion, and GYC will use reasonable efforts to accommodate that request.
7. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from and against all claims, demands, losses, liabilities, damages, costs, or expenses (including legal fees) brought by third parties arising out of or in connection with my attendance or participation in the Event or that of minors in my care, except to the extent caused by the gross negligence or willful misconduct of the Released Parties.
8. Severability & Governing Law
If any provision of this Waiver is held to be invalid, unenforceable or against public policy under applicable law, that provision will be severed or modified to the minimum extent necessary so that the remainder of this Waiver remains fully valid and enforceable.
This Waiver is governed by, and is to be construed in accordance with, the laws of Western Australia.
